New legislation has been pending in India that would regulate commercial surrogacy.  See Nilanjana S. Roy, Protecting the Rights of Surrogate Mothers in India(NY Times, Oct. 4, 2011).  Roy reports that the legislation, which is expected to be ratified, has also been criticized for affording more protections to commissioning parents than to the women who serve as surrogates.
