The U.S. Supreme Court has granted certiorari in Chafin v. Chafin, docket number 11-01347, to address a circuit split as to whether an order returning a child under the Hague Abduction Convention renders an  appeal of that order moot.  Chafin comes from the Eleventh Circuit, which treats such appeals as moot, see Bekier v. Bekier, 248 F.3d 1051 (11th Cir. 2001), but the 4th Circuit does not, see Fawcett v. McRoberts, 326 F.3d 491 (4th Cir. 2003). The Court’s web site has the Questions Presented; the cert petition and briefs are available on Westlaw at 2012 WL 1642602.

For the parallel state court divorce litigation, see Chafin v. Chafin, __So.3d __ 2012 WL 3055522 (Ala. Civ. App. 2012).
