As the Supreme Court begins its 2011 term, its docket includes Flores-Villar v. United States, docket no. 09-5801, a case challenging citizenship laws that distinguish between the nonmarital children of  U.S. citizen fathers and mothers.  In addition to the briefs of the parties, amicus briefs have been filed by groups including the American Civil Liberties Union, the National Immigrant Justice Center, the National Women’s Law Center,and several groups of academic scholars.   Arguments in the case are set for Wednesday, November 10.  The newest member of the Court, Justice Elena Kagan, is not likely to participate in deciding the case because of her role as Solicitor General prior to her nomination.  The opinion below is published at 536 F.3d 990 (9th Cir. 2009).
